  • How long will the family law process take?

    As soon as our office receives your completed application form and payment of your fees we will arrange a time that is convenient for you to conduct a telephone conference and obtain some background information and history from you. Within a few days, we will then provide you with a letter of advice, having regard to your instructions about the history of your relationship and the agreement that has been reached.

  • What happens if one party reneges on the agreement?

    Once your agreement has been formalised by the Court it becomes legally binding on all parties. The legally binding agreement, known as consent orders, it has the same legal implications and it would have orders been made as a result of a contested hearing. There are serious repercussions if one party does not comply with the consent orders. Should you find yourself in this position there are avenues you can pursue to have your court orders enforced by the Court.

  • Will you assist with implementing the orders?

    If you require a property to be sold or transferred our office can assist with the Conveyancing. From there are also able to disburse funds in accordance with your court orders.

  • Do we have to attend mediation?

    No, you do not need to attend mediation to use this service. Our service and the fixed fee associated with it does however depend to a large extent on your having reached an agreement on the division of your assets before you instruct us to prepare court documents on your behalf. Accordingly, if you do not have an agreement and are thinking about our service as an option, you might like to consider mediation as a way of resolving any outstanding issues before you use our service.

  • What happens if one party won't sign the documents once they have been drafted?

    We cannot force a party to sign an agreement. If all of the documents have been drafted we will endeavour to ensure that both parties sign off on the documents, so that they can be filed with the Court. If the negotiations break down, the agreement as then drafted may form the basis of further settlement discussions between the parties, however in this event, any work undertaken on behalf of one party will be outside the scope of the fixed fee.

  • Once these documents have been filed with the court does that mean we're divorced?

    No, these documents are designed to end the financial relationship between you. To dissolve the legal marriage between the two of you, a formal Application for Divorce will need to be made. Our office is able to assist you with this application online also. Please see our Online Divorce Application page to find out more about this process.

  • What's the difference between formal Court Orders and a Parenting Plan?

    Parenting plans are an informal agreement made between parents for the ongoing care arrangements for their children. Parenting plans cannot be enforced by a court in the event that one party decides they don't want to follow the plan anymore. That is to say, they are not legally binding.

  • Do we need to get advice before signing these documents?

    Although we always recommend to parties that they do opt to obtain their own independent legal advice, it is not mandatory to do so prior to obtaining consent orders. The party that instructs our office to prepare the documents will obtain independent legal advice from our office as part of the fixed fee.
